Terms of Service

1. Acceptance of Terms

By accessing or using BananaBanana ("the Service") at bananabanana.pro, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

BananaBanana is an AI-powered platform for generating images and videos using Google AI models including Nano Banana 2, Nano Banana Pro, and Veo 3.1. The Service allows users to create visual content from text prompts and reference images.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to create an account.
• One person may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. Balance and Payments

• The Service operates on a pay-per-use model with no subscriptions or monthly fees. Each generation deducts a fixed cost from your account balance.
• New accounts receive a $0.20 free welcome balance.
• Balance top-ups are processed by third-party payment providers. The available payment methods are shown at checkout; we currently accept Bitcoin (BTC), Ethereum (ETH), USDT, USDC, Litecoin (LTC), and 100+ other cryptocurrencies.
• Unused balance may be refunded under the conditions described in Section 15.
• Top-up bonuses (+5% on $50+, +10% on $100+) are applied instantly. Bonus amounts are promotional credits and are not refundable for cash.
• Generation prices may change at any time with reasonable notice.
• Your unused balance never expires as long as your account remains active.

5. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or abusive content
• Create content that infringes on intellectual property rights of others
• Generate deepfakes or non-consensual intimate imagery of real people
• Produce content depicting child sexual abuse material (CSAM)
• Create content promoting violence, terrorism, or hate speech
• Attempt to bypass content safety filters or model restrictions
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Resell or redistribute access to the Service without authorization

For clarity: the optional relaxed_filterparameter in our API and the "Relaxed Filter" toggle in the generator are not covered by the restriction above. They select Google's own permissive presets (safetySettings and personGeneration) — documented, supported parameters of the underlying Vertex AI models, intended to reduce false refusals on legitimate work. They do not disable Google's output-side safety classifier, which applies to every generation and cannot be turned off by any parameter, and they do not permit any content prohibited above. Using any other means to circumvent model safety systems remains prohibited. See our content moderation policy for details.

We reserve the right to suspend or terminate accounts that violate these guidelines without refund.

6. Content Ownership and Storage

• You retain rights to the prompts you submit and reference images you upload.
• Generated images and videos are yours to use for personal and commercial purposes, subject to the underlying AI model provider's terms of service.
• Generated content is stored on our servers for 30 days from the date of generation. After 30 days, generated images and videos are automatically and permanently deleted. It is your responsibility to download any content you wish to keep before the retention period expires.
• You may also delete your generated content manually at any time through the application interface.
• You are solely responsible for ensuring your use of generated content complies with applicable laws and does not infringe on third-party rights.
• We do not claim ownership of your generated content but retain the right to use anonymized, aggregated usage data to improve the Service.

7. AI-Generated Content Disclaimer

Content generated by the Service is produced by AI models and may not always be accurate, appropriate, or free from bias. You acknowledge that:

• AI-generated content may contain errors, artifacts, or unintended elements.
• The Service may refuse to generate certain content based on safety filters.
• Generated content may occasionally resemble existing copyrighted works by coincidence.
• You are responsible for reviewing generated content before using or publishing it.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

9. Rate Limits

To ensure fair usage, we may impose rate limits on API requests and generations. Excessive usage that impacts service quality for other users may result in temporary or permanent restrictions.

10. Limitation of Liability

To the maximum extent permitted by law, BananaBanana and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless BananaBanana and its operators from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the application settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Refund Policy and Billing Terms

• Unused balance. You may request a refund of the unused portion of a top-up within 14 days of the payment date. We refund the balance remaining from that top-up, excluding promotional bonus credits.
• Balance already spent. Credits consumed by completed generations are non-refundable: the service has been delivered and the underlying compute cost has been incurred.
• Failed generations.If a generation fails or is blocked by the model provider's safety filters, its cost is returned to your account balance automatically — no request is needed.
• How to request a refund. Email [email protected] from the address associated with your account. We respond to every billing request within 3 business days.
• How refunds are paid. Refunds are returned via the original payment method. Cryptocurrency refunds are sent as a stablecoin transfer to the address the payment originated from; on-chain transfers cannot be reversed once broadcast.
• Chargebacks. If something goes wrong with a payment, please contact support first — most issues are resolved faster than a chargeback. Accounts whose balance was obtained through a reversed payment may be suspended until the matter is settled.
